Bill Black: The Anti-Regulators Are the Job Killers

The Great Recession was triggered by the collapse of the real estate bubble epidemic of mortgage fraud by lenders that hyper-inflated that bubble. That epidemic could not have happened without the appointment of anti-regulators to key leadership positions. The epidemic of mortgage fraud was centered in loans that the lending industry (behind closed doors) referred to as “liar’s” loans – so any regulatory leader who was not an anti-regulatory ideologue would (as we did in 1990-1990 during the first wave of liar’s loans in California) have ordered banks not to make these pervasively fraudulent loans. One of the problems was the existence of a “regulatory black hole” – most of the nonprime loans were made by lenders not regulated by the federal government. That black hole, however, conceals two broader federal anti-regulatory problems. The federal regulators actively made the black hole more severe by preempting state efforts to protect the public from predatory and fraudulent loans. Greenspan and Bernanke are particularly culpable. In addition to joining the jihad state regulation, the Fed had unique federal regulatory authority under HOEPA (enacted in 1994) to fill the black hole and regulate any housing lender (authority that Bernanke finally used, after liar’s loans had ended, in response to Congressional criticism). The Fed also had direct evidence of the frauds and abuses in nonprime lending because Congress mandated that the Fed hold hearings on predatory lending.

The S&L debacle, the Enron era frauds, and the current crisis were all driven by accounting control fraud. The three “des” are critical factors in creating the criminogenic environments that drive these epidemics of accounting control fraud. The regulators are the “cops on the beat” when it comes to stopping accounting control fraud. If they are made ineffective by the three “des” then cheaters gain a competitive advantage over honest firms. This makes markets perverse and causes recurrent crises.

From roughly 1999 to the present, three administrations have displayed hostility to vigorous regulation and have appointed regulatory leaders largely on the basis of their opposition to vigorous regulation. When these administrations occasionally blundered and appointed, or inherited, regulatory leaders that believed in regulating the administration attacked the regulators. In the financial regulatory sphere, recent examples include Arthur Levitt and William Donaldson (SEC), Brooksley Born (CFTC), and Sheila Bair (FDIC). Similarly, the bankers used Congress to extort the Financial Accounting Standards Board (FASB) into trashing the accounting rules so that the banks no longer had to recognize their losses. The twin purposes of that bit of successful thuggery were to evade the mandate of the Prompt Corrective Action (PCA) law and to allow banks to pretend that they were solvent and profitable so that they could continue to pay enormous bonuses to their senior officials based on the fictional “income” and “net worth” produced by the scam accounting. (Not recognizing one’s losses increases dollar-for-dollar reported, but fictional, net worth and gross income.) When members of Congress (mostly Democrats) sought to intimidate us into not taking enforcement actions against the fraudulent S&Ls we blew the whistle. Congress investigated Speaker Wright and the “Keating Five” in response. I testified in both investigations. Why is the new House leadership announcing its intent to give a free pass to the accounting control frauds, their political patrons, and the anti-regulators that created the criminogenic environment that hyper-inflated the financial bubble that triggered the Great Recession and caused such a loss of integrity? The anti-regulators subverted the rule of law and allowed elite frauds to loot with impunity. Why isn’t the new House leadership investigating that disgrace as one of their top priorities? Why is the new House leadership so eager to repeat the job killing mistakes of taking the regulatory cops off their beat?

Protest or Witch Hunt?

But my sympathy and support for such a protest abruptly ends when the protest becomes “group think” and starts looking like a Witch Hunt. I was in Jakarta, watching stunned as several news reporters featured a young lady standing in front of News Corps’ Rupert Murdoch’s private home in New York City :shock: :lol: with a megaphone in her hand, shouting to the crowd and the news camera about how much he paid for his home, and what an extravagant lifestyle he had, while she and the gang standing with her didn’t get to live so high. She and her megaphone went on a rampage about other details of Mr. Murdoch’s private life, singling him out as if he personally affected her negatively in some way. It was disgusting.

Okay, Mr. Murdoch is a wealthy man. And, okay, perhaps his company takes corporate tax breaks. I have no idea. It’s not my business. I assume he pays his taxes along the lines of the current tax code as written into law, and he should. We all should, and we should do so proudly. As a side note, we’re lucky to live in America — with all our problems, it’s still one of the greatest places on earth to be. At any rate, Mr. Murdoch certainly doesn’t need me to vouch for him one way or the other. What I am particularly concerned about was that the protesters were harassing one segment of our population, and in particular, one individual. Police REFUSE to arrest protesters!

In Albany, last night, Governor Cuomo and Mayor Jennings ordered state and local police to enforce a curfew, and remove the Occupy Albany protesters.

The police defied those orders.

With protesters acting peacefully, local and state police agreed that low level arrests could cause a riot, so they decided instead to defy Cuomo and Jennings.

“We don’t have those resources, and these people were not causing trouble,” a state official said. “The bottom line is the police know policing, not the governor and not the mayor.”

Under pressure to make arrests, police and troopers push back

ALBANY — In a tense battle of wills, state troopers and Albany police held off making arrests of dozens of protesters near the Capitol over the weekend even as Albany’s mayor, under pressure from Gov. Andrew Cuomo’s administration, had urged his police chief to enforce a city curfew.

The situation intensified late Friday evening when Jennings, who has cultivated a strong relationship with Cuomo, directed his department to arrest protesters who refused to leave the city-owned portion of a large park that’s across Washington Avenue from the Capitol and City Hall.

At the Capitol, in anticipation of possibly dozens of arrests, a State Police civil disturbance unit was quietly activated, according to officials briefed on the matter but not authorized to comment publicly. But as the curfew neared, the group of protesters estimated at several hundred moved across an invisible line in the park from state land onto city property.

“We were ready to make arrests if needed, but these people complied with our orders,” a State Police official said. However, he added that State Police supported the defiant posture of Albany police leaders to hold off making arrests for the low-level offense of trespassing, in part because of concern it could incite a riot or draw thousands of protesters in a backlash that could endanger police and the public.

“We don’t have those resources, and these people were not causing trouble,” the official said. “The bottom line is the police know policing, not the governor and not the mayor.”

A city police source said his department also was reluctant to damage what he considers to be good community relations that have taken years to rebuild. In addition, the crowd included elderly people and many others who brought their children with them.

“There was a lot of discussion about how it would look if we started pulling people away from their kids and arresting them … and then what do we do with the children?” one officer said.

“Our official policy with peaceful protesters is that unless there is property damage or injuries to law enforcement, we don’t prosecute people protesting,” Soares said. “If law enforcement engaged in a pre-emptive strike and started arresting people I believe it would lead to calamitous results, and the people protesting so far are peaceful.”

Soares said another concern discussed by law enforcement officials :idea: :shock: :idea: was whether arrests could trigger an influx of young adults from Albany’s significant college community.

Joshua Vlasto, a spokesman for Cuomo, did not respond directly to questions about contact between Cuomo’s secretary, Larry Schwartz, and Jennings. “The state is working collaboratively with the city to enforce the curfew,” Vlasto said in a statement Friday evening.

And they clearly want to keep Cuomo-handler Schwartz’s exhortations under wrap…

Late Friday afternoon, after his contact with the governor’s office, Jennings took a hard-line stance and indicated he had instructed his police force to enforce the city’s curfew. He declined to talk about his conversations with Schwartz, saying: “It’s not important.”

Inside police circles, there was speculation by some officials that the pressure from the governor’s office to enforce the curfew was about political perception. They noted that some critics had questioned New York City Mayor Michael Bloomberg’s handling of a similar protest in lower Manhattan that has become an organized fixture, with medical supplies, food and even donated office space supporting the protesters.

Jennings and Krokoff could not be reached for comment on Sunday afternoon. About 30 tents remained as the sun rose Sunday morning, and protesters who stayed the night remained commited to staying in the park as long as their message had not yet affected change.

“I think this has to go on indefinitely,” said Chris Scully, 23, an engineer from Troy, as he wrote “Our Way Of Life is Dying” on a sign.

Local media outlets captured a small fight on video that happened during the Saturday night protest, a scuffle that apparently involved a passer-by trying to take a sign away from someone. But police made no arrests. The protest, called Occupy Albany, is an offshoot of the ongoing Occupy Wall Street protests in New York City that participants say aim to eradicate economic inequality. The protests have taken place across the country and spread overseas, including London.

The police strategy in Albany was evident early Friday. Krokoff issued a departmentwide memo instructing officers “to be continually aware of the possibility that a small element may intentionally seek to draw us into conflict,” according to a copy obtained by the Times Union. “At this time :lol: I have no intention of assigning officers to monitor, watch, videotape or influence any behavior that is conducted by our citizens peacefully demonstrating in Academy Park. … In the event we are required to respond to a crime in progress or a reported crime, we will do so in the same manner that we do on a daily basis.”

Assuming the Staties and Albany Police administrative cadres are not just plum-fuck stupid, they have to peg the people who own freeloader Cuomo as shivving them in a heartbeat before ever dreaming of ruffling Bloomberg or Kelly’s feathers…

Chemical bomb tossed
into Occupy Maine encampment

PORTLAND — Occupy Maine protesters say Sunday morning’s attack with a chemical explosive has left them with a mixture of anxiety and resolve.

“We are more motivated to keep doing what we’re doing,” said Stephanie Wilburn, of Portland, who was sitting near where the chemical mixture in a Gatorade bottle was tossed at 4 a.m. Sunday. “They have heard us and we’re making a difference.”

Wilburn said she was startled and briefly lost hearing in her left ear when the device exploded beneath a table about 10 feet away. Wilburn’s hearing returned and police said no injuries were reported.

Portland police Sgt. Glen McGary said the bomb was thrown into the camp’s kitchen, a tarped area where food is cooked and served. Protest organizers said the explosion lifted a large table about a foot off the ground.

“There was no fire . . . We had a good 20 feet of thick smoke rolling out from under the table,” Wilburn said. They could see the “G” on the 24-ounce bottle and its orange cap, as well as bits of silver metal, she said.

She and a friend who ran over to look at it breathed in fumes that smelled like ammonia, she said.

Witnesses said a silver car had been circling before the attack, its occupants shouting things like “Get a job” and “You communist.” They believe someone from that car threw the device, according to a statement from Occupy Maine.

Risk on the rise as political leaders give in to mob rule

We are in the midst of a deleveraging,

But, being at each other’s throats is our biggest problem.

Our character :lol: and our political :lol: and social :lol: systems are now being tested in ways that have typically been tested in past deleveragings. In deleveragings bad economic conditions typically lead to emotional reactions, social and political fragmentation, poor decision-making and increased conflict. When this occurs in democracies, the checks and balance system, which is intended to yield the best decisions for the whole, can stand in the way of thoughtful leadership and lead to ineffective “mob” rule. This dynamic can lead to a self-reinforcing downward spiral.

Frustrations increase, the established ways of doing things come under attack and frustrations over the ineffectiveness of government creates the perceived need for someone to gain control of the mess. Plato spoke of this dynamic. It was the reason Hitler was elected in 1933.

In our opinion these types of risks are now emerging and should be taken into consideration when trying to figure out what may lie ahead. Rather than trying to resolve disagreements through thoughtful discourse, people are now trying to grab power to beat and suppress their opponents. Tensions between the rich and the poor, capitalists and socialists, those in and out of power and different factions in each group are now intensifying in a manner that is classic in deleveragings. Politicians who are fighting for power in a political year are fanning the flames and are increasingly willing to do risky things (like shutting down the government) in pursuit of their missions and popular support.

This growing populism will have important implications for monetary, fiscal and trade policies and will significantly increase risks of a markets downturn and a global depression.

Regarding monetary policy, the mob is at the gates of the Federal Reserve and wants to grab control while those on the inside are in disagreement about what should be done. Fed chairman Ben Bernanke and those who helped him save the country from depression are now under siege. These challenges are being faced in different forms by most central banks at the same time as they are nearly out of ammunition – i.e., their capacities to ease are very limited because they cannot stimulate private credit creation and because they cannot get money in the hands of people who will spend it. For these reasons there is greater risk that central banks cannot save us as they have always saved us in the past.

The battle between the left that wants to tax the rich more and the right that wants to cut entitlement spending is at a fierce stalemate that is likely to intensify in more scary ways. As a result, fiscal policy is unlikely to be supportive to economic growth.

With high unemployment and growing anger, the “mob” is blaming the foreigners who “took their jobs,” especially the Chinese who they say are “manipulating” their currency to “compete unfairly”. And since politicians want popular support, they are navigating this issue to gain political benefit (e.g., to put the US President in the position of having to choose between the political suicide of vetoing Senator Charles Schumer’s currency bill

.. and clashing with China) rather than to approach this difficult issue calmly and analytically. Trade flows and capital flows are increasingly being looked at by all sides as possible weapons in an economic war. As a result, the risks of bad surprises in trade and capital flows are heightened.

Mobs are at the doors of bankers and others in the financial system, screaming to politicians to put these people in jail while the vote-seeking politicians are fanning the flames rather than reminding people that the legal system is the way these people should be judged. Since banks are levered about 15 to 1, it doesn’t take much of a debt problem to cause them solvency problems, and since in deleveragings debt problems are big, there is significant risk banks will run out of equity again and the fury against them will intensify. For these reasons risks to the global banking system are much greater than normal.

While we hope that most people and their leaders will approach these difficult challenges calmly and collectively, we would not be meeting our fiduciary responsibilities if we bet on this happening without clear evidence of it. We are not alone in having and expressing our concerns in what has come to be known as “risk-on” and “risk-off” market movements.

If we calm down and work together to properly manage this difficult situation :lol: – for example, if we can properly distribute both the austerity and the increased efforts that are required to manage our debt burdens – we can get through this deleveraging without great pain. :roll: If we can’t, we may experience an economic, social and political collapse.
