Here is the article in SF Gate yesterday on the moves coming from HHS w/r/t religious exception, protection for Catholic hospitals, doctors, and other religious health care professionals who do not wish to provide care to women, or to any one else, based on religious exception. It will over ride the hodge podge of state laws that we have… additionally it will exempt Catholic and religious orgs from having to provide birth control coverage in health plans. When an EMPLOYEE chooses (their fragile conscience!) to not dispense birth control in a pharmacy (which are state licensed) currently, under our state law, they are to direct the woman to another provider who will. I thought that was a goddamed concession to Catholics and fucked fundies, in my opinon, at the time…

Now they will not even have to do that… Now based on a health care provider’s personal belief that you should not receive care, for moral religious or personal reasons, they can withhold information.

Although some have interpreted the proposal more narrowly, Deirdre McQuade, the U.S. Conference of Catholic Bishops’ spokeswoman on abortion, said the goal is to protect those who object to any form of artificial contraception.

“Pregnancy is not a disease to be treated by abortion, and neither is fertility,” she said. “To be coerced to treat it as if it were a condition that is pathological is unjust.”

Under this they will not have to make a referral. Maybe in a city, a big one, this does not seem to be an inconvenience, in small towns it will be.

Here is the kicker…

Violators would forfeit federal health care funds, which in California amount to as much as $37 billion a year.

The draft regulation describes the problem as laws such as those in California and New York that require employers to include contraceptives in any prescription drug coverage they offer to employees. The federal agency had no comment Wednesday on the proposal.

I am at the end of patience, with politics, with religion, with both parties and with all electeds.. And coming right at the end – before BushCheney skate off, I doubt there is great energy, any energy, in the weak limbed, brain fogged and RW compliant Democrats to do more than mumble. They did nothing to amend Medicare, Part D, a mess and a horror.

According to the draft regulation, health practitioners are often unaware of their rights and are encountering “an environment in the health care industry that is intolerant of certain religious beliefs, ethnic and cultural traditions, and moral convictions.”

Requiring states and federal fund recipients to honor the refusal of health care practitioners and others to take part in procedures they find objectionable would promote “a more inclusive, tolerant environment,” increase diversity in the medical field, and affect states “only insofar as they engage in illegal discrimination,” the proposal says.

Planned Parenthood’s Kneer said opponents will campaign as hard as they can to stop the regulation, lobbying Congress as well as federal officials. If they fail, she said, they’ll ask the next administration to repeal it.

Last, our CASC just ruled that a lesbian who was denied IVF care at a practitioner, has to be accommodated, regardless of the provider’s opinon of her sexual orientation or marital status. She herself did finally find care and did become pregnant, but the case was to establish the law of her right to seek the procedure and not be denied..

OUT THE WINDOW, if HHS, Bush, Wingers and conservative – and collaborator – Dems get away with this one. The problem is that the Right always wins part of what they want, then, as zealots, they keep on.. til they get more.

IMO this codifies, further, the right of the religious, in their perceived victimisation (forced to do their fucking JOB, forced to acknowlege that the secular world is important), to abuse the rest of us.

In his opposition to abortion, he is out of synch with Party members as well as with the Party platform; twice during his rise through Colorado politics, pro-choice Democrats tried to derail his career—in 1993, when he was appointed district attorney of Denver, and in 2005, as he was preparing to run for governor. “When I was making phone calls, raising money,” he said, “I probably talked about abortion in ninety to ninety-five per cent of my calls.” Many potential donors said that because of his view they couldn’t support him.

And there is this, as though the world is static from 1865 onward:

“We never had slavery out here,” Gary Hart said. “I mean, it’s a Southern issue. And obviously the number of African-Americans is smaller, but that’s not the point. UPDATE, KGO is saying the personal exception will extend beyond religion to personal and moral reasons for refusing. And fully covers an event in a hospital related to something the worker refuses to take part in, they cannot even sterilise instruments. And I assume they would refuse a box of Kleenex for a rape vicitm who will be receiving the day after pill.

Greens condemn curfews, anticonstitutional police harassment of innocent citizens in Arkansas and DC, and the War on Drugs as “self-defeating” in efforts to eliminate crime

WASHINGTON, DC — Green Party candidates and leaders called the 24-hour curfew imposed on the city of Helena-West Helena, Arkansas, a gross violation of the rights of local citizens and a symptom of the rapid growth of unrestrained police power over the past two decades.

Politicians and law enforcement officials have justified such measures as part of the war on drugs. Greens have endorsed an immediate end to the drug war, calling it a catastrophic failure.

“A city that hands its police force a license to trash the constitutional rights of its citizens is not a city that is upholding law and order and protecting its citizens. On the contrary, unlimited police power is a complete breakdown of the law,” said Joshua Drake, Arkansas Green Party nominee for Congress (4th District) (http://www.drake08.com).

The curfew in Helena-West Helena (http://www.msnbc.msn.com/id/26171820/), a response to the crime rate in some neighborhoods, empowers officers armed with military rifles to stop and interrogate citizens without warrent or any semblance of probable cause.

A similar curfew has been imposed on Washington, DC’s Trinidad neighborhood, where the police have established checkpoints allowing officers to question all drivers entering the area. Citizens must convince the police they have a “legitimate reason” for their presence in the neighborhood.

“These interrogations and checkpoints are comparable to police practices in authoritarian regimes and especially apartheid-era South Africa — which is even more ominous given the fact the residents of these new ‘Red Zones’ are mostly African American and poor,” said Rosa Clemente, the Green Party’s nominee for Vice President of the United States (http://www.rosaclemente.com). “Such measures also recall the repression by police and private security firms in post-Katrina New Orleans, which accompanied the obstruction and expulsion of mostly poor and black residents from their homes.”

“These policies have only empowered criminal gangs involved in the drug trade, just as Prohibition fed the growth of organized crime. The ACLU is right — two of our most important freedoms, the right of mobility and protection against warrantless search and seizure, are being nullified for the sake of the disastrous war on drugs, in violation of local law and the US Constitution,” added Ms. Clemente. Greens noted that curfews and harassment of citizens reflect the militarization of civilian police departments enacted by the Clinton Administration in the mid 1990s, with officers trained in military tactics to fight the drug war.

Along with police militarization and the expanded war on drugs, the Nixon, Bush Sr., Reagan, Clinton and Bush Jr. administrations also oversaw the rapid growth of the private prison industry, which profits from filling up prison cells with more and more inmates. The outcome has been record incarceration of US citizens, especially of young African American and Latino men locked up on nonviolent offenses and plea-bargaining deals.

“Democratic and Republican politicians are equally responsible for the transformation of civilian police into militias,” said Abel Tomlinson, Green nominee for Congress in Arkansas’ 3rd District (http://www.abelforcongress.com). “The drug war has very little to do with drugs — it’s about control, coercion, and power. It’s about money. America won’t get sane drug laws and law enforcement until enough Greens get elected to public office to overturn these self-defeating, unconstitutional policies.”

The Green Party supports the principle that governments can best address crime and drug use by promoting local self-determination and residents’ ownership of their own communities, observing citizens’ rights, and recognizing that addiction is above all a medical problem.

In a meeting the Journal Sentinel reporters and editors, Moore said she can “really see the damage that was done” by the long fight between nominee-to-be Barack Obama and Hillary Clinton.

One measure: The personal access Clinton supporters in Congress are demanding from Obama.

“I have seen people who from my perspective are very, very unrealistic about this man’s time,” said Moore, who supported Obama. “They have said, ‘He needs to come meet with me.’ Some of them have been Hillary supporters. I have felt very sympathetic toward Sen. Obama, because he can’t break himself into 20 different parts.

“They don’t want to meet in groups. They want to meet one-on-one with him. I don’t know if they’re trying to extract things from him. I don’t know if they want to have bragging rights that they met with him,” Moore said, before declaring: “I don’t need any face time with Sen. Obama. I need Sen. Obama to do what he needs to do.”

Moore said any Clinton supporters unsure about backing Obama should look at the differences between Obama and Republican nominee-to-be John McCain, especially on issues such as the economy, health care and the Iraq war.

“I think anyone still pouting over Sen. Clinton is not focused on these things and it’s just about personalities,” Moore said.

She added: “I’m bewildered by some of the disgruntlement. Maybe it’s easy to say, because the person I backed won. But John Edwards, Hillary, Barack Obama — I can remember feeling totally satisfied about the prospect of any one of the three becoming the nominee.”

What a horrible abuse of authority:

It appears that a principal at Ponce de Leon High School felt that he had made an important discovery himself in Florida. Principal David Davis was shocked when a student came to him about being harassed about being a lesbian. It was not the harassment but the lesbian part that shocked Davis who immediately lectured the girl on her immoral lifestyle, told her to stay away from children, and then outed her to her parents.

Davis’ outrageous treatment of the girl, known only as Jane Doe, prompted a quiet protest from other students. Showing far more sense and compassion than the school, the students became to well (began to wear?!?!) gay pride symbols in solidarity. Davis responded by allegedly questioning the sexuality of the other students and suspending some of them.

The American Civil Liberties Union successfully sued the district and Davis was demoted. What is most alarming is that you cannot be fired for engaging in raw discrimination and harassment on the basis of sexual orientation — not to mention interjecting your own religious views into a school setting.

The result makes more sense when you read the response of Steve Griffin, Holmes County’s school superintendent: “We are a small, rural district in the Bible Belt with strong Christian beliefs and feel like homosexuality is wrong.” Griffin always keeps a bible on his desk and has framed Scriptures in his office to greet students and parents who want to speak with him. Given his boss, it is curious that Davis wasn’t promoted over the incident.

When McCain was shot down, on October 26, 1967, he was busy bombing what he would describe as a “heavily populated part of Hanoi.”

What follows is a a rather entertaining passage in which Moore then asks what you would do to a man who “fell out of the sky” after dropping bombs on you or your children. But the most important question comes at the end:

John McCain is already using the Vietnam War in his political ads. In doing so, it makes not just what happened to him in Vietnam fair game for discussion, but also what he did to the Vietnamese … I would like to see one brave reporter during the election season ask this simple question of John McCain: “Is it morally right to drop bombs and missiles in a ‘heavily populated’ area where hundreds, if not thousands, of civilians will perish?”

On Monday, National Review magazine posted an online article saying the university had initially declared that the records were open to inspection but that the university subsequently reversed its position.
