Justice Department officials have selected a new leader for the public integrity unit, a special corps of prosecutors who investigate corruption in police departments, the judiciary and Congress, according to two department sources.

The job has been offered to Jack Smith, a career department prosecutor from Brooklyn who in recent years has supervised sensitive investigations of foreign officials

Raymond Hulser, a longtime prosecutor at the department, has been chosen to serve as the principal deputy, the sources said.

Assistant Attorney General Lanny Breuer, who leads the criminal division, could confirm the move later Thursday, subject to administrative approvals.

This guy Hulser is a real piece of work. Early on at DoJ during the Clinton Admin, Hulser steered the Travel Office case AWAY from Hillary, the Thomasons and Foster.

But Dale’s attorney, Steven C. Tabackman, intends to lay out a case much like a political thriller, complete with amateur spies, interference by a Hollywood producer and missing documents that Dale claims could exonerate him by proving that the unaccounted-for funds went to pay for media travel.

Tabackman’s strategy is to turn the attention away from Dale and put administration officials on trial, especially Clinton’s third cousin, White House aide Catherine A. Cornelius.

Attorney Stephen Braga, who represents Cornelius, dismissed Tabackman’s strategy as “a standard defense tactic” to divert attention from the defendant and denied that Cornelius did anything wrong.

Tabackman also privately has told a federal judge about a secret witness who will testify about Dale’s missing documents: a record of the office’s petty cash disbursements and a log of checks Dale deposited in his personal account to cover tips and other job-related expenses.

Justice Department lawyers Stuart M. Goldberg and Raymond N. Hulser argue there is no proof that Dale’s documents ever existed and suggest that if they did, Dale could have taken them himself. The prosecutors also point out that no other travel office employee knew about the record Dale says he kept on checks he deposited in his checking account. Braga said Cornelius, who was caught secretly copying and taking home office records, has never seen the documents Dale says are missing.

U.S. District Judge Harold H. Greene recently dealt Tabackman a setback by denying a request to subpoena a cast of characters involved in the travel office firings, including Hillary Rodham Clinton and Hollywood producer Harry Thomason. But he said he will reconsider the request after he sees what evidence the government produces.

Disagreements among prosecutors pose challenges to case against Blackwater

As the U.S. investigated Blackwater Worldwide contractors for a deadly 2007 shooting in Baghdad, a legal debate was playing out behind the scenes at the Justice Department between two veteran prosecutors. One urged caution. The other aggressively pushed the case forward.

The disagreement foreshadowed problems that in December led a judge to dismiss manslaughter charges against five contractors who fired machine guns and grenades into a busy intersection. The dismissal outraged Iraqis and sent the Obama administration scrambling to repair a case that is all but in ruins.

In dismissing the case, U.S. District Judge Ricardo Urbina said prosecutors ignored the advice of senior Justice Department officials and built their case on sworn statements that had been given under a promise of immunity. Documents unsealed Tuesday in response to a request by The Associated Press and The Washington Post paint the clearest picture yet of how the case prosecution went awry.

Immediately after the Sept. 16, 2007, shooting, Blackwater contractors told State Department investigators what happened. Two days later, the security gave written statements under a promise that nothing they said could be used against them in a criminal case.

Because of that deal, prosecutors had to make sure they didn’t use the written statements to build their case. It was unclear, however whether prosecutors could use the Sept. 16 interviews.

Ken Kohl, the lead prosecutor, believed he could. And he thought Raymond Hulser agreed.

Hulser is among the Justice Department’s experts on Garrity V. New Jersey, the Supreme Court case that spells out how to deal with these kinds of immunity deals. Hulser did not agree with Kohl.

“I think that we agreed that there was an issue regarding the Sept. 16, the earlier statements,” Hulser testified in one of several closed-door hearing last year that ultimately persuaded Urbina to dismiss the case. “My view was that the risk was such that they shouldn’t take it. His view was that they had a good chance of arguing the other way.”

Hulser repeatedly tried to warn Kohl that building the investigation on those interviews could jeopardize the case.

Former Hevesi Aide Pleads Guilty in Pension Case

ALBANY — The former chief investment officer for the state’s pension fund pleaded guilty to securities fraud on Wednesday, saying he helped steer pension money to political contributors to former State Comptroller Alan G. Hevesi and to companies that paid kickbacks to Mr. Hevesi’s top political consultant, Hank Morris.

The guilty plea by David J. Loglisci, who has agreed to cooperate with investigators from the office of Attorney General Andrew M. Cuomo, is among the most significant developments in the case since it began nearly three years ago and suggests that the inquiry is moving closer to Mr. Hevesi.

In State Supreme Court in Manhattan, Mr. Loglisci described a “culture of corruption” under Mr. Hevesi, saying senior officials in the comptroller’s office directed him to gain approval from Mr. Morris before signing off on investments.

“I effectively ceded my authority over the alternative investment portfolio to Morris,” Mr. Loglisci said, reading from a prepared statement. “Morris corrupted the investment process to favor those who either made contributions to the comptroller’s campaign, which Morris managed, or agreed to pay placement or other fees to Morris or his associates, and to punish those who would not.”

The whole point of forging a compromise is to… get a deal done. I don’t get why Democrats like to stick with the compromise even when there’s no deal. The point is to say, “suppport this, or we’re gonna pass some crazy commie hippie shit.”…

Now I have actually coined a few phrases in my time, wayback when I, too, began my “online political life.” Who could forget “shnoofenloogenhoffer”, which developed out of a famous online exchange one Friday evening in May of 1987, a riff on the whole “farfevnugen” VW Advertising campaign? And Fuck, I actually
have worked at Harvard, Yale, and Princeton. Mostly brokering bales of Hawaiian out of the back of a boxtruck 35 years ago, to some VERY BIG NAMES in Academia I might add, but you don’t see me trying to embellish my resume with it.
I do not understand, tho: What some people won’t do to reach the top as a Senior Fellow at Media Matters. Just don’t understand.

hmm I was still dropping in at Atrios when his commenters FORCED him to admit he worked at Media Matters (as do others, Oliver Willis as I recall, a very pompous hump)… Duncan was badgered to first admit then to post it. Which at the time he did, by putting the MM connection at the very bottom of the blog in very small letters.

For some reason all the boy blahgger boychicks have had just the worst time with any sort of disclaimer or admission.

In a sense, the uproar actually helped him: To wipe the spit off his face, Biden had to say it was only rain. Therefore, he lauded Netanyahu’s assertion that actual construction in Ramat Shlomo would begin only in another several years.

Thus Israel essentially received an American green light for approving even more building plans in East Jerusalem.

Biden might not know it, but the Palestinians certainly remember that this is exactly how East Jerusalem’s Har Homa neighborhood began: Then, too, Netanyahu persuaded the White House that construction would begin only in another several years. ….
