What next I wonder…. Roeder phones from Wichita jail, it seems once a day or so… complains of this or that and speaks darkly of acts to come. Some abortion providers have been offered protection, others not.  Apparently one of the criteria is that you must be the visible face for abortion rights in your area or a nationally known provider… and even then, not all of those are given a visit, from city, state or federal law enforcement.

I asked moiv if Emily Lyons had been the visible face for abortion care in her area, before being bombed and blinded by Eric Rudolph…  Well, no… she was not, til he nearly took her face off…. then she was nationally known.

von Brunn is undergoing heroic efforts to save his life (which is fine with me I prefer to hear from these sorts, than for them to be neatly put down as though they have nothing yet to give up) and of the Arkansas shooter?  He seems to have slipped beneath the waves.. Supposedly under surveillance by the EFF BEE EYE – for a year, following, they say, radical conversion to Islam and a trip to Yemen, where he was arrested for traveling on a Somali passport.  (I did not know Somalia was together enough to issue passports, apparently so.)

But whoops.. where was that surveillance?

Someone in the government is very happy von Brunn came along to help sink the ARK shooter..him.. just a guess on my part.

In the quick meantime… the ptb have been like pigs for the truffle.. He had connections, connections you say!  to the BNP, the ultra nationalist British party that just managed to scam a few seats in the election.  His ”connection”?  He attended Northern VA meetings designed to raise money for the BNP.  A beleaguered (if loaded with ugly opinions and beliefs, earlier acts)  pensioner living with his son and claiming, so his supremacist friends say, that his Social Sec had been “slashed” and, he believed, it was due to his beliefs.

Yes … what next.

Obama defends DOMA in federal court. Says banning gay marriage is good for the federal budget. Invokes incest and marrying children.

Joe and I have been trying since last night to get a copy of the government’s brief just filed in this case. This is not the GLAD case that we’ve written about previously, it’s another in California.

We just got the brief from reader Lavi Soloway. It’s pretty despicable, and gratuitously homophobic. It reads as if it were written by one of George Bush’s top political appointees. I cannot state strongly enough how damaging this brief is to us. Obama didn’t just argue a technicality about the case, he argued that DOMA is reasonable. That DOMA is constitutional. That DOMA wasn’t motivated by any anti-gay animus. He argued why our Supreme Court victories in Roemer and Lawrence shouldn’t be interpreted to give us rights in any other area (which hurts us in countless other cases and battles). He argued that DOMA doesn’t discriminate against us because it also discriminates about straight unmarried couples (ignoring the fact that they can get married and we can’t).

He actually argued that the courts shouldn’t consider Loving v. Virginia, the miscegenation case in which the Supreme Court ruled that it is unconstitutional to ban interracial marriages, when looking at gay civil rights cases. He told the court, in essence, that blacks deserve more civil rights than gays, that our civil rights are not on the same level. snip

I’ll be blunt, Obama is not looking hard ass here.. HE is looking SCARED.

He’s from Oakland, California, and is a former prosecutor who then, while an attorney at Morrison & Foerster, defended John Walker Lindh, the “American Taliban.” He also was the co-chairman of Obama’s fundraising committee. This is an Obama person. And his name is on this brief.

The fact he was on the Lindh case is deceptive. He was on the team of the old time Dem isde of the bed senior partner (who was at MoFo at the time) who took the Lindh case. His name escapes me at the moment.

Once again…Congress has to repeal DOMA. Obama is obligated by the Constitution (as is his DOJ) to enforce the laws we have. DOMA is a law. Congress can repeal it and then Obama can sign the repeal. Obama cannot do anything but enforce this law.

Asking Obama to do anything but enforce this law is demanding that he use the Unitary Executive. I guarantee you do not want him to do that, so stop demanding it.

A fox has been unmasked as the mystery thief of more than 100 shoes in the small western German town of Foehren, authorities said Friday.

A forest worker stumbled upon shoes strewn near the fox’s den and found a trove of footwear down the hole which had recently been stolen overnight from outside locals’ front doors.

“There was everything from ladies’ shoes to trainers,” said a local police spokesman. “We’ve found between 110 and 120 so far. It seems a vixen stole them for her cubs to play with.”

First they came for the socks, and I giggled . . . then they came for the shoes. . . .

I also wondered how old the kits were by the time the stash was discovered. Maybe the mama had started bringing the kits along on night raids for food, and the family shoe count really snowballed as the kits themselves began to collect trophies from their pre-K training sessions in scavenging?

Update: FBI probes anthrax scare in Schenectady.

SCHENECTADY – Federal, state and local law enforcement agencies descended on the city’s Mont Pleasant section after the discovery of a container labeled anthrax, officials said today.

A law enforcement official said the investigation is at least in part focused on Congress Street, which has been closed at Broadway.

The FBI was called in after police learned about the container, said officials who spoke on condition of anonymity. It is unclear if the discovery poses any danger.

A county official said someone has been taken into custody, but the FBI has declined to say whether an arrest has been made.

The FBI would say little about the case.

And the Obama Justice Department has filed to dismiss a federal gay marriage case that challenges the Defense of Marriage Act (DOMA). AmericaBlog parses the filing and finds its defense of DOMA “despicable, and gratuitously homophobic” (“He told the court, in essence, that blacks deserve more civil rights than gays, that our civil rights are not on the same level”). There are scared Obamaites running around dkos insisting that protesting means nothing. IOW, dog forbid TEH GAYZ should get out there in the streets in DC and tell Obama exactly what they think of him – loudly. They should organize a million gays march and go for it. I’m sure enough of them are angry enough now to make that happen. More power to ’em.

that photo is from the protest outside his SO California fundraiser of a couple of weeks ago, gays protested and inside he laughed at them. Gotta love it.

Less talked about twas that despite big money sponsors and a myriad of music performers, the tickets moved slowly and one tier of a three tier event had to be dropped down to the lowest price to sell it out.

All about hope and change.

BTW – regarding the NYS Senate – yet another judge (this was #3, I think) told both sides to work it out over the weekend (and asked for a copy of arcane Senate rules), or else. Good luck with that! Not sure the pols are even bothering to pretend they’re gonna try to “solve” this themselves.

Monserrate (the indicted Dem girlfriend-slasher) is continuing to dither, however, so the whole House of Double-Faced Cards (and how!) could tumble at any time.

Meanwhile, some GOP idiot in the Assembly took brave and crucial action in another important arena the other day – he wrote a Big Missive to the network demanding that David Letterman be fired (!!!) for recent Palin jokes.

They should all be fired themselves, for Impersonating Public Officials.

There are multiple reports that the text-messaging systems on cellphone networks in Iran went down just before the polls opened. Boing Boing reader Jadi says, “Right now, there are many ongoing protests in the streets against the fraud and still SMS system is down.”

Probably trying to stop people from using the systems to organize, as they have in other countries.

Why I Now Support Gay Marriage By TOM SUOZZI

WHEN I ran in the Democratic primary for governor against Eliot Spitzer in 2006, I vocally supported civil unions for same-sex couples but did not endorse equal marriage. I understood the need to provide equal rights for gays and lesbians, but as a practicing Catholic, I also felt that the state should not infringe on religious institutions’ right to view marriage in accordance with their own traditions. I thought civil unions for same-sex couples would address my concerns regarding both equality and religious liberty.

I was wrong.

I have listened to many well-reasoned and well-intentioned arguments both for and against same-sex marriage. And as I talked to gays and lesbians and heard their stories of pain, discrimination and love, my platitudes about civil unions began to ring hollow. I have struggled to find the solution that best serves the common good.

I now support same-sex marriage. This is a subject of great debate before the New York State Legislature (although the legislators there are a little distracted right now), and I hope that same-sex civil marriage will be approved within the month.

Under current New York State law, same-sex couples are deprived of access to the employment benefits, life and health insurance and inheritance laws that heterosexual couples have. If the state were to institute civil unions for same-sex couples, that discrimination would end, but we’d still be creating a separate and unequal system.

Civil unions for both heterosexual and same-sex couples would be an equal system, but this compromise appears unlikely at the current time. Few heterosexual couples would give up their current civil marriage for a civil union. While some states would recognize civil unions for all, others would not, causing legal problems for New York couples. Advocates of same-sex marriage don’t seem in favor of such a compromise either.

Any change in the New York law can, and must, balance equality while making sure that religious institutions remain free to choose whether to marry same-sex couples. By following the example of Connecticut and Vermont, which included protections for religious institutions when they recently legalized same-sex marriage, we can ensure that churches are not forced to consecrate marriages they do not endorse. This will require a strong liberty clause allowing religious institutions to opt out of solemnizing same-sex marriage, which also applies to the provision of services and programs at religiously affiliated institutions.

Many civil marriages are not considered “holy matrimony” by religious institutions because they do not conform to the rules of the religious institution. Those marriages have not challenged religious liberty. We must see that civil marriage, which has always been separate from religious marriage, will remain so.

But most important, gays and lesbians have suffered too long from legal discrimination, social marginalization and even violence. They are entitled to clear recognition of their equal status as citizens of a country that is founded on the principle that we are all inherently worthy. By delivering a clear message that same-sex couples can no longer be treated as separate and unequal in New York, we will also reduce discrimination in everyday life. We will all be better for that.

Equal civil marriage should, and likely will, pass because of the public’s growing unwillingness to sustain inequality. Society will also be strengthened as more people take responsibility for one another in marriage. I now encourage others who oppose gay marriage to re-examine the reasons they do so, and to consider changing their minds too.

Iran’s supreme leader, Ayatollah Ali Khamenei, closed the door on any chance he could use his limitless powers to intervene in the disputes from Friday’s election. In a message on state TV, he urged the nation to unite behind Ahmadinejad, calling the result a “divine assessment.”

Isn’t that the same phrase the supremes used about Bush?

SACRAMENTO, Calif. – A convicted terrorist can sue a former Bush administration lawyer for drafting the legal theories that led to his alleged torture, ruled a federal judge who said he was trying to balance a clash between war and the defense of personal freedoms.

The order by U.S. District Judge Jeffrey White of San Francisco is the first time a government lawyer has been held potentially liable for the abuse of detainees.

White refused to dismiss Jose Padilla’s lawsuit against former senior Justice Department official John Yoo on Friday.

Obama v justice for torture victims. This should be fun.

I just read today that hte lead name on the brief, West, (Simpson was the actual author) is the husband of Kamala Harris, our Democratic Party star (they tell us all the time!) and SF ugh… she is not city atty… she is the city DA (had to search my brain a bit). A top supporter and personal friend of ObRama.

These people so need to get over themselves.
